With an aging population, dealing with irreversible illnesses such as Dementia and Alzheimer's is a growing concern for us all and a reality for many. What to do in any situation when a person is unable to make decisions on their own behalf due to an accident or illness is a
​daunting matter. In this very sad and upsetting circumstance, a Guardianship/Intervention Order may be needed. If there is no Power of Attorney in place and the individual does not have the understanding to grant one, then a Guardianship or Intervention Order may be required to allow someone to make important decisions about financial and welfare matters on their behalf. 

GUARDIANSHIPS & INVERTION ORDERS...

WHAT IS A GUARDIANSHIP AND/OR INTERVENTION ORDER?  

Both are similar court applications to have someone appointed to make decisions on another’s behalf. Both can cover financial matters (e.g. investments) and/or welfare matters (e.g. medical treatment). The difference is: 

  • Guardianship Order - for on-going decision making
  • Intervention Order - for one-off actions (e.g. selling a house or moving someone).


WHAT WE DO…  

We will guide you through the process keeping you informed at all times. Such orders should be last resorts and we will give practical advice to ascertain if there are other options available.


If an Order is necessary we will:

  • Request supporting reports (typically one from GP, one from Consultant Psychiatrist and one from Mental Health Officer)
  • Draft application and lodge with Sheriff Court
  • Attend Sheriff Court Hearing
  • If necessary, obtain a ‘bond of caution’ (insurance) to cover the Guardian’s management of finances.
